煽动民族歧视罪是一种刑法规定的犯罪行为,其侵犯的法益为民族平等权利,即是对具有某种民族身份的个体或不特定多数人的政治、经济和人身权利的拟制的危险。民族歧视是一个需要明确的概念,充满着强烈的价值色彩。煽动民族歧视则指使用语言、文字、网络或其他方式鼓动、渲染、怂恿等基于具体民族的歧视行为。

The crime of instigating ethnic discrimination is a criminal offence which violates the right of ethnic equality, that is, a violation of the political, economic and human rights of some individual or a special group. Ethnic discrimination requires a clear definition and has a strong value color. Instigating ethnic discrimination means the use of some language, writing, internet or others to incite or instigate such ethnic discrimination.
