我国完善植物新品种保护制度的战略定位

Strategy Location of Improving the New Plant Variety Protection System in China

植物新品种保护制度,是一种与国民经济基础联系极为紧密的知识产权制度。完善该制度,目前必须充分考虑粮食安全、农业现状、育种科研水平等在内的基本国情,应当从国家农林业、粮食以及植物资源安全、育种人权益、提升制度层次、强化保护等方面进行重点把握。面对挑战,我国要积极应对,应抓紧开发植物资源并对其实施新品种权保护、制定鼓励国有和民营育种科研原始创新政策、以高于UPOV1978文本标准完善植物新品种保护制度等方面,为尽早与国际UPOV1991文本全面接轨做好准备。

The new plant variety protection system is an intellectual property system,it is closely linked with the basis of our national economy.In improving it,at the present time we must think about food security,agriculture status,level of research breeding in national conditions.And we should mainly master agriculture and forestry security,food security and plant resources security,breeder rights,system level,strong protection in improving the new plant variety protection system.Facing challenges,we must have active measures to cope with UPOV1991： to promptly exploit plant resources,and to implement new plant variety rights perfection;to draw up policy of the original innovation of research breeding to encourage national and private organization or enterprise;to improve the new plant variety protection system overtop UPOV1978 standard.
