On Historic Tradition of Chinese Case Law

判例法是中国传统法律体系中不可或缺的重要组成部分。中国的判例法传统经过数千年的发展变迁,到今天仍然发挥着重要影响,它是由制定法的超稳定性、儒家思想法律化和判例法本身固有的优点几方面原因共同作用而形成的。和英美法系不同,中国的判例法从属于制定法,并通过国家立法机关认定的方式,实现向制定法的转变。

The case law is the indispensable and significant integral part of Chinese traditional legal system. Through the development and changes in thousands of years, Chinese case law tradition, which consists of the ultra-stable statute law, the legalized Confucian thoughts and the intrinsic advantages of the case law itself, is still exerting important influence today. Compared with the Common Law family, Chinese case law is subject to the statute law, and realizes the shift to the statute law through affirmation by the national legislative institutions.
