我国城市生活垃圾污染防治的法律对策研究

Researches on the Legal Countermeasures for Pollution Prevention of City Trash in China

城市生活垃圾现已成为我国一个严重的环境问题,引起了中央的高度重视和社会的广泛关注。本文结合我国城市生活垃圾的现状,简要分析了其所带来的危害,并通过对我国城市生活垃圾污染防治的法制状况的分析,借鉴国外立法,提出修改、完善《固体废物污染环境防治法》的相关内容,建立相应的"子法"相配套实用,构建环境友好型社会。

The city trash has already become a serious environmental problem in China, attracting great attention of the Chinese Party Central Committee and widespread social concerns. This article briefly discusses the harm brought by the present situation of the household garbage in Chinese cities. It also analyzes the condition of the legal system for pollution control of domestic waste in China and uses foreign legislations for reference. Based on the above, it is proposed that the relevant contents be revised and improved with respect to ＂The Law on Prevention and Control of Environmental Pollution by Solid Waste＂, establishing corresponding derived laws to combine with it. In this way an environmental-friendly society is to be established.
