创新集体建设用地使用权流转制度的思考

Innovation on the Transferring System of the Usufruct of Collective Construction Land

农村建设离不开土地资源这个重要载体,需要土地、资金等保障和支撑。而集体建设用地使用权流转所存在的内在障碍,恰恰正是新农村建设普遍遇到的突出矛盾。虽然集体非农建设用地使用权流转受到法律的严格限制,但流转仍呈现了相当的规模。集体建设用地流转由于在法律政策上未得到明确的认同,缺乏合理的规制,容易滋生土地纠纷,因此将农村非农建设用地纳入市场规范流转势在必行。本文正是在这样的背景下开展对创新非农集体建设用地使用权流转的研究,对规范集体建设用地使用权流转提出若干设想和制度设计。

The land resource is an evitable part in the rural construction, which needs land and finance support. However, the inner obstruction existing in the transfer of the usufruct of collective construction land is the prominent issue in the modern rural construction. Although the transfer of the usufruct of collective non-agricultural construction land is strictly limited by the law, the transferring phenomena are still on a scale. Since there are no definite provisions in the law and lack of reasonable regulations concerning the collective construction land transfer, which likely resulting the Land disputes, then it is imperative to bring the rural non-agricultural construction land into the stan- dardizing market circulation. This paper aims to study on the innovation on the transfer of non-agricultural collective construction land usufruct and to propose the system design to regulate the transfer of the usufruct of collective construction land.
