论我国民事责任体系的构建

On the Construction of the Civil Liability System in China

本文从民事责任的概念入手,分析了民事责任与民事义务的关系以及民事责任的内容和种类,探讨了民事责任的立法体例及主要学术观点,并在此基础上提出构建我国民事责任体系的设想,即在民法典的总则编、物权编、债权编总则、合同编与侵权责任编分别规定民事责任。

This article analyzes the relation between civil liability and civil obligation as well as civil liability content and type from civil liability concept angle. It discusses the legislative style of civil liability and the main academic viewpoint, based on this and proposes the plan of our country civil liability system. In the code civil general rule part, the real right part, the creditor＇s rights general rule part, the contract part and the tort liability part the civil liability should be stipulated separately.
