法律渊源:正当理由的来源

法律渊源不是法律本身,而是独立于法律之外的本体。法源之法包括立法者之法和执法者之法,立法者之法是一般规范,执法者之法是针对个案的个别规范。法律渊源既指一般规范的来源,又指个别规范的来源。无论是一般规范的来源,还是个别规范的来源,其实质蕴意是正当理由的来源。

The source of law is not the law itself, but the noumenon being outside the law. The laws in the source of the law include the law of legislator and the law of executive. The law of legislator is general norm, while the law of executive is individual norm. The source of law not only means the source of general norm, but also means the source of individual norm. The substantial meaning about the source of general norm and the source of individual norm is the source of due cause.
