摘要
雇佣关系为现代社会之普遍现象,雇员在职务中损害第三人利益的情况也时有发生。我国应比较各国民法规定,出台详尽的规定:在归责原则问题上,应考虑到雇主较雇员资力悬殊的特别情况,在所有的情况下,让雇主替代雇员赔偿;在第三人确认上,应对雇员是否也属于第三人加以具体规定;在职务范围的认定问题上,应对雇佣关系转移加以规定;在雇员的行为是否要求构成侵权的问题上,应采用肯定的观点。
Employment relationship is very common in modern society, and incidents of employee damaging the interest of a third party often happen. Our country should legislate detailed regulations by comparing with the civil laws of different countries. As the principles of imputation, we should make the employers compensate for the employees in any case based on their wide gap in solvency; as for the confirmation of the third party,we should make specific stipulation whether the employees be the third party or not;on defining the scope of duty, we should stipulate the shift of employment relationship;and positive ideas should be adopted to judge whether the employees have infringing act or not.
