人民监督员制度漫谈

On the System of People Supervisor

作为对检察机关职务犯罪侦察权的一种监督制约机制,人民监督员制度正在全国范围内进行推广,但自该制度诞生之初便争议不断,诸多焦点问题亟待厘清。本文首先从该制度实施现状出发,进而通过与人民陪审员制度的横向比较探讨了立法时机问题,并对该制度的正当性基础进行了分析,文中最后提出了完善该制度的设想。

As a surveillance and restriction mechanism of the detective fight of procuratorial organ in duty crimes, the system of people supervisor is now being popularized throughout the country. However,it has a lot of controversy which needs to be clarified ever since its coming into being. The article, based on the current situation of implementation of the system, explores the legislation time by the comparing with the system of people assessor. It also analyzes the validity basis and finally offers a design for perfecting the system of people suoervisor.
