摘要
WTO成立以来世界范围内的文化贸易量急剧增长,与此同时文化例外、文化多样性的价值诉求也日益显著。欧洲作为人类文化资源最为丰富的地域之一,其在自由贸易体制下寻求自身文化产业发展所采取的政策法规为其在战后文化贸易领域内争得一席之地起到了积极作用。在文化与贸易冲突广泛显现的大背景下,作为成员国文化政策优先权和国际贸易合作者的要求之间的协调者,欧盟的实践也为在经济一体化与文化多样性之间实现平衡的未来国际法体制提供一个示范。
There has been an obvious increase of international cultural trade since the establishment of the WTO. At the same time, there has eventually been a public acceptance of cultural exception and cultural diversity as an important value in the international society. As one of the richest regions with cultural resources, the European oountries and the EU have taken many effective measures including polices and laws which have advanced European cultural industry and are worth being learnt from by us. Under the international background of the conflict of culture and trade, the practices of the EU as the coordinator of the priority of cultural polices of the members and the request of the ocoperation of international trade, also provide an example to the approaching international legal system with the balance of economic integration and cultural diversity.
