两型社会与公民法律观念的更新

On the Two-type Society and Citizen's Legal-Consciousness Innovation

公民法律观念的更新是两型社会建设的前提和关键。首先,只有更新公民法律观念才能为法律制度创新提供有力的支持;其次,公民法律观念的更新可以为法律制度的完善提供舆论监督;第三,公民法律观念的更新将为加强制度能力建设提供有力保障。要更新公民法律观念,至少要把握以下三个方面:首先,明确生态主义价值观,坚持以节约资源和保护环境这一基本国策作为价值判断标准;其次,培养适应两型社会建设的思维方式,使公民自觉以大自然家庭中一员而不是自然界征服者?统治者的身份思考、创制和适用法律;第三,培育人与自然和谐发展的社会心理,把节约能源资源?保护生态环境内化成公民自身的道德义务,完成两型社会从法律制度到法律秩序的转变。

The two-type society construction presupposes the citizen＇s legal consciousness innovation. First of all, it is only the innovation of citizen＇s legal consciousness, which could provide powerful support for legal system innovation; secondly, citizen legal consciousness innovation may provide public opinion supervision for the perfection of legal system, thirdly, the innovation of citizen＇s consciousness may provide strong guarantee for strengthening legal system capacity construction. The innovating of citizen legal consciousness demands attention from the following three aspects ： firstly, making clear of the ecological value consciousness, adhering to the judging criterion of viewing the resources-saving and enviromnent-protection as the fundamental state policy; secondly, cultivating the thinking mode which fits for two-type society construction, making the citizens think, innovate and fit for the law as a membership of the whole family rather than as nature conqueror, ruler; thirdly, fostering the social mentality on human-nature harmonious development, making the energy-saving and ecological environment protection consciousness to be the moral responsibility of every, citizen, canying out the transfer of the two-type society from legal system to legal order.
