摘要
无单放货现象在海运实践中大量存在,具体情形也纷繁复杂,常因行为人的不同、相对人的不同以及促成行为的主、客观条件的不同而构成不同性质的法律关系,承运人并就此承担不同的法律后果,具体包括法律免责、违约责任和侵权责任。
In maritime practice no original bill of lading put goods case has various practical types, but what is its legal nature has become hard question. The paper tries to classify many sorts practices and give the reasonable legal analysis. The carrier may have three different legal aftermath according to diferent practices of no original bill of lading put goods case, respectively including breach duty, tortious duty or irresponsibility.
