论信访权的宪法地位

On the Constitutional Position of the Right of Letters and Visits

信访权是有中国特色的,最传统、最贴近民生的一项公民权利。信访权具有与其它各项宪法权利不同的价值和功能,是其它宪法权利无法涵盖的。只有将信访权上升为宪法权利,在宪政视野下架构信访制度,才能使信访的价值和功能得到真正实现。

The right of letters and visits is the right most traditional, closest to the people＇s life and with Chinese characteristics. Compared with other constitutional rights, the right of letters and visits is with different value and function and can never be substituted by the other constitutional rights. Only by elevating the right of letters and visits to the height of constitutional rights and constructing system of letters and visits on the basis of the constitution and politics, can the value and function of letters and visits be truly realized.
