非刑罚处罚标志着人类社会的文明进步和人的价值的实现,它既是科学发展的必然要求,又是推进和谐社会构建的有效手段。但目前非刑罚处罚在我国司法实践中存在诸多问题,其中既有理念上的障碍,也有立法和司法规范中存在的问题,因而有必要对之修改和完善,以更好地体现人本精神和促进社会和谐。

Non -penalty punishment symbolizes the advancement of human civilization and the realization of human values. It is both the inevitable requirement of scientific development and an effective method promoting the construction of a harmonious society. But now it has many problems in our judicial practice, which has obstacles on ideology, legislation and judicial standard. Thus, it is necessary to revise and perfect non - penalty punishment so that it can better embody humanism spirit and help the society to be harmonious.
