世界知识产权组织(WIPO)域名仲裁中的“准先例法”

域名,从技术角度讲指在Internet上用于解决IP地址对应问题的一种方法。域名抢注一般指将他人的商标、商号等注册为自己域名的行为。近年来,域名系统的组织、管理和相关的知识产权纠纷一直是全球范围内人们激烈争论的焦点。世界知识产权组织(WIPO)于1999年11月29日接受国际互联网络名址分配公司ICANN指定,成为第一个"域名纠纷处理服务提供者",在互联网域名争议的解决中发挥了不可估量的作用。从WIPO仲裁与调解中心解决域名争议的主要法律依据《统一域名争议解决规则》(UDRP)入手,综合大量WIPO仲裁实例,运用案例分析、图表分析、比较等研究方法,对W IPO域名仲裁中法律适用的一些基本规律进行归纳和提炼,并创造性地提出WIPO域名仲裁实体法适用中的"准先例法"理论。

Domain name, from a technical view, is a kind of method to solve the problems of IP address parallelism. Cybersquatting usually means the behavior of registering other people＇ s trade mark and/or trade name as one＇ s own domain name. In the recent years, the setup, administration of domain name system and the related intellectual property disputes have long been the focus of discussion worldwide. WIPO, being the first Service Provider of domain name dispute settlement appointed by ICANN, has played a significant role in solving Interuet-related domain name disputes since its receiving of authorization on November 29, 1999. This paper starts with The Uniform Domain Name Dispute Resolution Policy （UDRP） , it also introduces many WIPO arbitral cases. The paper sums up some fundamental rules of WIPO＇ s domain name arbitration and finally educes the theory of ＂quasi stare decisis＂.
