摘要 晚期的罗尔斯将目光转向国际社会,提出以"生命权、自由权、财产权和形式平等权"为核心的基本人权思想。这一思想深受国际人权斗争的现实及国际人权理论发展的影响,特别是舒尔和文森特的低度人权理论的影响。尽管罗尔斯的基本人权思想有助于减少国际人权领域的分歧,但是我们应该从实然和应然及人的自然属性和社会属性的角度看待基本人权问题,防止把基本人权演变为另一种意义上的普遍人权。 Rawls＇s attitude towards human rights changed greatly, in an early stage he supported citizens＇ rights, but in a later stage he insisted the right to life, to liberty, to property and to formal equality. Rawls＇ s Human Rights Minimalism is influenced by Henry Shue, R.J. Vincent and Hart. But we should understand basic human rights through human being＇ s social character and natural character, through the realistic and idealistic level.
