农村土地征收中的利益冲突及补偿机制和政策调适

Interest Conflicts,Compensation System and Policy Adjustment of Land Expropriation in the Rural Area

近年来,伴随我国经济建设和城镇化水平的快速发展,大量农村土地被征用,与此同时,农村土地征收中的利益矛盾和冲突也不断加剧,已经成为影响社会和谐稳定的一个突出问题。从本质上说,现行农村土地征收中存在的一系列问题,都是缘于与土地征收相关的各方主体的利益之争。在土地征收的各方利益主体的博弈中,国家和广大农民是最大的利益受损者,不仅对国家的长远和战略利益构成严重威胁,也极大地侵害了农民的合法权益。对此,必须深入研究农村土地征收中的利益矛盾和冲突,深化征地制度改革,不断完善征地补偿机制,以切实保护广大农民的合法权益,确保农村社会的和谐稳定。

With the economic construction and development of urbanization in China, large amounts of land have been expropriated in recent years. The contradictions and conflicts of interest in land expropriation have consequently been sharpening. The series of problems of land expropriation in the rural area result from the struggle for interests of different parties involved in the land expropriation. The biggest loser of interests in land expropriation is both the state and farmers since land expropriation threats the long-term and strategic interest of the state and meanwhile infringes upon farmers ＇ legal rights and interest. To safeguard farmers ＇ legal rights and interests and maintain the harmony and stability in the rural area, the following measures should be taken： the contradictions and conflicts of interests in land expropriation should be intensively studied; institutional reform of land expropriation should be intensified; compensation system of land expropriation should be continually improved.
