摘要
从契约理论的视角看,政府对公立大学实行的委托-代理方式代表了一种"不完全契约"关系,存在着较大的履约风险;在现代契约理论视域中,公立大学与政府的契约关系正在发生内涵质变:由身份附属意义的契约关系转向平等主体间的契约关系、由统括性契约关系转向特定性契约关系。"缔约-评估"构成了公立大学与政府之间契约管理的实践模式。
By the view of contract theory, the model of cient-proxy for government to govern public university represents a kind of relationship of incomplete contract, which biggish risk to carry out contract is in it. The contracted relationship between public university and government is changing its connotation, the identity attaching is transforming into one of equality intersubjectivity,and general into specifically one. Contracting-Evaluating constitutes the practical model of modern contracted governing between public university and government.
