法律规制视角下的土地使用权租金制度刍议

随着我国土地市场的逐步发育与完善,土地租赁制度作为国有土地有偿使用的一种重要方式,其优势日趋凸显。同时,也对土地二级市场起到了有益的牵带作用,越来越受到供用地双方的青睐。城市土地年租制相对于批租制具有明显的合理性,但该制度在我国尚处于探索阶段,仍然存在许多不尽完善之处。因此,从土地租赁制的缘起出发,在明确其优势的同时,分析相关法律上年租制存在的问题,进而论证建立土地使用权租金法律规制的必要性,对于大力推进国有土地租赁使用方式,推进租赁有偿用地制度具有十分重要的现实意义。
