越轨行为的发生与奥林匹克法律规范体系的完善

Occurrence of Deviant Behavior and Perfection of Olympic Legal Norm System

越轨表明了主体对规范的态度,能折射出规范本身存在的问题,因而具有淘汰旧规范的先导与推动作用。奥林匹克运动中同样存在着越轨现象,发生的越轨行为涉及多个奥林匹克主体,而由多层次规范组成的奥林匹克法律规范体系却难以对其有效控制。通过研究奥林匹克中的越轨行为,发现奥林匹克法律规范体系在权威性、完整性、冲突性、价值原则和制度性方面存在问题,是其不能很好控制越轨行为发生的重要原因。对此,笔者针对性的提出了修订和完善的建议。

Deviant behavior indicates the subject＇s attitude towards the norm and reflects the problem of the norm. As a result, it can help abolish the old norm. Deviant behavior exists in Olympic movement and involves multi Olympic subjects. However, the Olympic legal norm system made up of multi - layer norms cannot effectively control the deviant behavior. This article points out problems of the Olympic legal norm system in its authoritativeness, completeness, contradictoriness, value principle, and mechanism by researching the deviant behavior in Olympics, which are major reasons why deviant behavior cannot be well controlled. Suggestions to revise and perfect the Olympic legal norm system are also proposed
