涉及南京大屠杀史在日诉讼五案评析及其启示

A Review of Five Lawsuits in Japan Concerning Nanjing Massacre and the Implications

10多年来,包括李秀英诉日本政府案在内共有五个涉及南京大屠杀史的诉讼案件在日本审理,其终审结果不尽相同,有胜有败。笔者作为涉案当事人,通过分析和评价这五个诉讼案的起因、实质、审判过程、审判结果,阐释诉讼案本身对于维护南京大屠杀史实、唤起人们的历史记忆,进而达到以史为鉴,开创未来,维护和平等诸方面的重要历史意义和现实价值。

In the past decade, up to five lawsuits concerning Nanjing Massacre, including the one filed by Li Xiuying against the Japanese government, have been adjudicated in Japan, the final judgments ranging from victory to defeat. The author, as a litigant, by analyzing and reviewing the cause, the essence, the process and result of adjudgment of the five lawsuits, expounds both the historic significance and the realistic value in keeping the facts of Nanjing Massacre, evoking historical memories, and then drawing a lesson from history, inaugurating a new future as well as maintaining peace.
