摘要
本文从专利资产证券化的动因入手,分析了专利资产证券化的基本法律原理,指出了目前中国法律环境开展专利资产证券化存在的法律冲突与缺失,认为信托型SPV是最适合我国专利资产证券化的模式。
The article begins with the motive of patent asset securitization, analyzes the fundamental legal principles, and poinits out the conflicts and deficiencies in patent asset securitization in China＇s current legal environment. It considers trust SPV is the most applicable module in China＇s practice.
