摘要
江溯博士《社会团结、集体意识与刑罚》一文较为中肯地梳理了涂尔干的刑法社会学思想。其中所介绍的涂尔干对于分工发达的现代社会中"有机团结"代替"机械团结"、"恢复性制裁"代替"压制性制裁"的变迁式思考对我国当代刑罚改革具有重要意义。
JIANG Su＇s Social Solidarity, Collective Consciousness and Punishmen introduced the Durkheim＇s thought of sociology of punishment pertinently. Durkheim＇s ideas about the Organic Solidarity replace Mechanical Solidarity, the repressive sanctions replace restitutive sanctions in modernistic society have important significance to the reform of punishment system of our country.
