论渔政公务人员

On the administrative officers of fisheries

由于历史的、现实的原因,目前许多渔政人员的文化水平偏低,未能依法纳入公务员管理,未能依法享受国家公务员待遇,部分渔政部门一直依靠差额拨款或自收自支维持运转。基于《中华人民共和国公务员法》和相关渔业法规,阐述了渔政公务人员的概念,分析了他们依法应享有的权利和应履行的义务,探讨了他们可能承担的法律责任。为了实现渔业行政管理的公正和有效,应严格依照公务员法录用渔政公务人员,保障其依法应享有的各项权利;对违反渔业法规及公务员法规的渔政公务人员,应依法追究其相应的法律责任。建设一支学习型、服务型、责任型、由公共财政予以充分保障的渔业行政执法队伍,是真正实现依法治渔和依法兴渔的前提条件。

Due to a variety of historical and current reasons, many administrative officers of fisheries are not well-educated, not admitted as civil servants and do not enjoy the legal rights of civil servants, and some fisheries administrations are not run totally by the public finance. Based on the ＂Law of Civil Servants＂ and the related fisheries law and regulations, the paper expounds concept of fisheries civil servants, analyzes their legal rights and duties, and explores the possible legal liabilities. To achieve fairness and efficiency in fisheries administration, recruitment of fisheries officers should be performed strictly in accordance with the law of civil servant, their legal rights should be protected, and those fisheries officers who break the law and regulations of fisheries and civil servants should be punished. On the condition that a learning-oriented, service-oriented, reponsibility-oriented and public finance supported crew of fisheries officers, the principle ＂Regulate and promote fisheries in a legal way＂ may be followed strictly.
