摘要
作品、发明和商标作为知识产权的权利对象不仅外观形态上都表现为符号组合,而且本质上与符号的非物质性、整体性和任意性特征吻合。知识产权对象的共性是符号性。相应地,知识产权法价值原则的核心是权利对象所表现出的区别性。知识产权法在规则设计时关注的焦点也应从权利对象的创造性判断转变为权利对象的区别性判断。
Works, patents and trademarks as the objects of intellectual property right manifest themselves as semiotic combinations, and, by nature, correspond with the non-physical, entirety and arbitrariness of the sign. What the objects of intellectual property right have in common is semiocity. Accordingly, the core value principle of intellectual property law is to discriminate between one object and another. The focal point of regulating intellectual property right should thus shift from judging the creativity of the objects to discriminating between the objects.
