我国目前农村土地征收过程中存在利益失衡问题,农民利益受到侵害,一些不正当利益大量滋生,甚至不法利益大行其是。经过考察,我们认为在农村土地征收过程中应当纳入利益衡量范围的主要应是农民利益与公共利益。在利益衡量的过程中,应确保农民利益得到合理补偿,并且这种补偿应是与社会保障并行的合理补偿;应确保征收的目的是为了公共利益;在农民利益与公共利益的冲突中,应以征收之后利益综合衡量的结果为正数作为判断标准;并且在征收过程中要注意正确衡量公共利益之间的冲突。

In my opinion , only farmer＇ s interest and public interest should be taken into account in the rural land expropriation. In the process of the rural land expropriation, The compensation to the farmers should be reasonable, meanwhile, social security should be provided to them; The intention of the rural land expropriation should only be for public interest; The confliction between the deferent public interest should be harmonized.
