On the Property Nature of the Franchising of Resources

资源利用的法律问题随着人类生活水平、技术水平的提高及资源稀缺性的加强而被重视。从资源保护的角度看,中国资源立法的缺陷,重要的不是公法意义上的资源管理法规的缺陷,而是私法保护体系的严重不足。文章明确了资源特许经营权的物权属性,提出资源特许经营权作为一种私权还需要物权法详细而具体的制度支持。

With the improvement of human living standards and technology standards, as well as the going scarcity of resources, the legal problem of using resources draws more and more attention. In the perspective of protecting resources, the very defect of Chinese law concerning resources is not that of administrative law on resources, but that of protection system rooted in private law framework. In order to clarify the property nature of the franchising of resources, and to recognize the franchising of resources as a kind of private right, we need detailed and specific systematic support from the Property Law.
