On the Breach to the Duty of Care in Supervision-neglience

监督过失是对被监督者过失行为注意义务的违反。监督过失中的注意义务违反存在两种表现形式:作为犯罪和不作为犯罪。监督过失主观上只能限于能够预见到被监督人的过失行为,不能扩展到对危害结果的预见。监督过失,存在监督者的过失和被监督者的过失,监督者与被监督者注意义务内容的不同决定了他们并没有形成一定的注意义务共同体。

Supervision-negligence is the breach to the wards of court, whose duty of care is negligent. In supervision-negligence, there are two kinds of manifestations in the breach of the duty of care： crime of commission and criminal omission. Supervision-negligence is only restricted to foresee the negligence of the ward of court＇s in subjective, the result of danger cannot be foreseen. Provost＇s negligence and and ward of court＇s negligence are included in supervision-negligence, and the different duties between provost and ward of court determine that they can not form a certain community about duty of care.
