网络侵权管辖权问题探究

On the Jurisdiction over the Network Tort

介绍了网络侵权的特征,对美国等国家的网络管辖权理论和司法实践进行简要评析,并对一些新的网络管辖权理论及模式进行了深入探讨,试图找出新的管辖模式,并对中国的现行网络侵权立法做出评析及立法建议。

At first, this paper introduces the characteristics of network tort and makes a short analysis on the theory and jurisdiction practice of the network jurisdiction in the USA and etc. Then it gives a further discussion of some new theories and models of network jurisdiction with the purpose of looking for a new model of network jurisdiction. In the last part, this paper analyses the current legislation over network tort in China and gives many legislation advices.
