On the Mode of Real Right Alteration

物权变动是物权立法政策和立法技术上的重大课题。当今大陆法系国家已经生效的几种物权变动模式各有其利弊。我国物权法确立的物权变动模式既注重契合中国实际又注意借鉴国外的经验,是值得肯定的、适合我国国情的物权变动模式。

The alteration of real right is a significant subject in legislative policies of real right and legislative technology. As far as the main continental law systems are concerned, there are advantages and disadvantages in their alteration modes of real right respectively. Our alteration mode of real right not only pays attention to her own practice, but borrows advanced ideas and experiences from abroad, which is trustworthy as well as satisfactory to utmost maximize the value of right in rem.
