摘要
刑法修正案已成为我国未来立法修改的主要方式,但目前刑法学界关于刑法修正案立法的研究还不是很多,对此问题还未引起充分重视,我们有必要从理论上加以深入探讨。我国刑法修正案的立法权由全国人大常委会来行使有一定合理性,但《立法法》应对增设新罪是否属于"制订"的范围作出明确规定或解释;我国刑法修正案的生效时间不宜一律采用公布之日即施行的做法;刑法条文修改后个罪归属可作适当调整;刑法修正案的修改不宜过于频繁,其修改内容应该注意严密性和科学性;刑事判决书中应同时援引刑法修正案与刑法条文。
It is true that,in China,an amendment to the criminal law must be made by the Standing Committee of the National People's Congress.But,in Law of Legislation,specifications and explanations should be given so that it is clear whether adding any new category of crime means 'to legislate'.It is not advisable that amendments,without exception,all go into effect only on the day when they are made public.Modifications should be allowed even after the criminal law has been amended,for law amendment is not a frequent but a rigorous and scientific procedure.Criminal judgment should invoke both amendment and articles of the criminal law.
