Patents not only protect and encourage invention and creation, but also break through the technological blockade, promote the outcome of new technology popularization and application, promote scientific and technological progress of innovation. Drug patents play an active role for the protection of drug markets, and pro- mote and protect the autonomy new drug research and development. This paper describes China＇s patent system and pharmaceutical patent protection, the patent application subjects of traditional Chinese medicine and the trends of patent applications. The researchers could make a preliminary understanding of the Chinese patent medicine, apply for a patent on the research results for protecting their legitimate rights and interests, and to promote and protect of the independent drug research and development.
