足球裁判行使判罚“自由裁量权”的影响因素探析

Analysis on Influence Factor of the Soccer Referees Exerting the Free Jurisdiction

任何法律的实施和执行,都要由具有主动精神的法官去实现,足球裁判的执法行为应当是研究足球裁判问题的重点。运用问卷调查、数理统计以及法理分析等方法,对足球裁判员临场判罚的影响因素进行调查和分析。通过解析足球裁判自由裁量权的概念和基本特征,重点分析足球裁判行使判罚自由裁量权的若干影响因素,规则与规则价值、自由心证等内在因素与竞赛外环境、裁判临场心理、执法动机等外在因素是影响裁判行使判罚行为自由裁量权的重要因素。

Any law implementation and enforcement must be decided by active judges to realize, studied on football referee of action of decision should be emphases. In this paper, the questionnaire, statistics and legal analysis were used to investigate the influence factors. From the perspective of jurisprudence, the author defined the concept of discretion of the referee, analyzed the influence factors such as rules and the value of rules, free proof or psychological factors of referees and motivation, which are importance to referee of decision rooted in free jurisdiction.
