“草根经济”中的知识产权制度失灵现象及其探究

Analysis of System Malfunction of Intellectual Property Rights in Grass-root Economy

"草根经济"是指那些从家庭小作坊起步并至今仍带有原先经济模式痕迹的传统制造企业。从我们对长三角地区传统制造业创新转轨问题的调查情况看,"草根经济"中的知识产权保护存在着一定程度的制度失灵现象。这种制度失灵既和我国知识产权保护在民间缺乏足够的道德支持有关,也和知识产权制度的保护密度不适应"草根经济"的现状有关,还和我国知识产权制度的执法强度受到行政部门、乡亲情面等外部因素的干扰有关。知识产权制度失灵已经成为阻碍"草根经济"创新转轨的一大障碍,严重影响着我国传统制造业的健康持续发展。而改善知识产权保护教育,强化知识产权保护中的道德约束力,将是克服"草根经济"中知识产权制度失灵的重要对策。

Grass-root economy refers to those traditional manufacturing enterprises rooted from family workshops and still bearing some previous imprint.From our investigations into the innovative transformation among traditional manufacturing industry in Yang Zi Delta,we find that the phenomenon of system malfunction exists,by a certain margin,in the intellectual property protection of grass-root economy.The phenomenon of system malfunction is not only associated with the intellectual achievements' public goods characteristics,but correlated to the fact that the contents of intellectual property system and grass-root economy practice are unable to match with their forms,and it also has a bearing up on the absent education of intellectual property ethics.System malfunction of intellectual property rights has turned out to be a stumbling block retarding the innovation and transformation of grass-root economy,which has severely affected the sound and sustainable development of traditional manufacturing industry in China.As a result,intensifying the moral education of intellectual property rights together with supplementing and supporting the intellectual property system with ethical codes will be an important count-measure to overcome system malfunction of intellectual property rights in grass-root economy.
