论商标反向假冒行为的法律规制

On the Legal Regulation of Reverse Passing-off

理论界对商标反向假冒行为定性问题的分歧尚存,原因之一是忽视了商标权的积极权利,从这一视角对该行为的商标侵权性进行经济学的法理分析有助于对商标反向假冒行为的准确定性。商标反向假冒行为可以被认定为商标侵权、欺诈和不正当竞争等行为的竞合,这种侵害法益的多重性,决定了对其进行多维度的法律规制的必要性。鉴于新《商标法》及相关法律规定的操作性不强,应该完善各相关法律,以期形成合力,达到对商标反向假冒行为真正有效的规制。

Differences still exist among scholars as to the nature of the reverse passing off of trademarks, partly due to the negligence of active rights of trademark right. An economical analysis of reverse passing off infringement in the light of the active rights would be helpful to the determination of its nature. Reverse passing off of trademarks can be deemed as the concurrence of trademark infringement, fraud and unfair competition. This multiplicity of infringement on legal interests necessitates a multi -dimensional regulation of reverse passing off. As the new trademark law and relevant laws are not easy to operate in practice, An effort should be made to perfect the relevant laws,with a view to form a concerted effort, in order to achieve a real effective regulation of reverse passing off.
