American private international law of the vested rights era:viewing from legal philosophy perspective

摘要 20世纪前半期美国国际私法的理论基础是既得权理论,故称既得权时代。该时期美国的国际私法受分析实证主义法学思潮的影响,其法律发展的基本途径和方法是法律的移植。 American private international law at the first part of 20th century is based on the vested rights theory, so this era can be called that of the vested rights. American private internation- al law at this age is influeneed by legal positivism. The develop- ment way of American private international law at this age ks the transplantation of law.
