论和谐社会立法上相对主义的公平观

On the relativist justice conception of the legislation in harmonious society

法律是对有关公共幸福事项的合理安排,社会主义和谐社会构建必须以公平的立法为基础,现行法律体现的公平精神不足,法学界和立法界应当对立法公平问题充分关注。社会主义和谐社会立法应当贯彻相对主义的立法公平观,落实"不被歧视权"和"获得差别对待权"等权利,追求在结果上可资比较的相对公平。

The laws are reasonable arrangement to make the public comfortable. The construction of the socialist harmonious society should be based on the justice legislation.The actual laws don＇ t show enough justice. The jurisprudentiai and legislation circles should care much about the fair problems of the legislation. The activities of legislation of the socialist harmonious society should carry out the fair conception of the relativism so that the laws can make the right of not being ignored; the right of being treated differently and so on come true. And it purchases the comparable relative justice.
