法经济学研究的几个热点问题述评

法经济学作为一门独立的学科地位已经确立,但是法经济学要进一步发展,首先,需要对效率与公平进行价值整合,定量分析方面则需要进一步改进;其次,法经济学的发展应该立足于实务应用研究与本土化研究,而不能满足于一般的文献介绍;最后,要重视对法经济学的学科整合研究,否则从经济学的进路研究法经济学在本质上是制度经济学或者是单一的成本收益的工具分析,从法学的角度来说,如果没有溶入经济学理论,则完全陷入法哲学的分析进路。

Law and economics as an independent subject status has been established, but it needs further development according to following steps. Firstly, justice and efficiency must be balanced and quantificational research must be ameliorated. Secondly, the development of law and economics must be established in research of application and localization rather than common literature introduction. Thirdly, the incorporation of law and economics must be stressed, otherwise the research in law and economics from economics angle is institutional economics or single cost-benefit analysis tool in essence. On the other hand, from law angle, if not incorporated in economics, the research may plunge into law philosophy.
