Starting from the objectivity and contingency of enterprise＇s operational risk, this paper probes into the importance of establishing the concept of aforehand precaution of legal risk, and probes into the problems of how to construct the basic framework of legal risk precaution system and how to establish the check-and-balance system of the legal precaution of enterprise＇s operational risk for arousing the higher attention of enterprise＇s policy-makers to prevent and avoid enterprise＇s risk.
