摘要 针对居民区附近商住楼和居民小区内餐饮业污染问题的投诉呈逐年上升趋势。污染产生的原因,主要是业主环保意识淡薄、污染源处理设施不完善、监测手段和环保部门介入滞后以及处罚缺乏足够的法律依据。纠纷调处时环保部门的管理对策提前介入,杜绝餐饮企业污染环境;对申请开业的餐饮企业控制办法:控制数量、合理选址、使用清洁能源及安装污染源处理设施并办理环保竣工验收手续;对已开业的,在工商年检时执行环保前置年检,逐步淘汰不合格的企业,尽快完善专门的行业管理条例。 Complaints about the problem of pollution with the restaurants that lie near or in the residence communities have been increasing year by year. The reasons for pollution are mainly due to weak consciousness of environmental protection, lack of pollution-source-processing facilities and the means of monitoring as well as environmental protection administration getting involved lagging behind and lack of actual viable law items for administrative penalties. Therefore, to those enterprises that have applied for opening, the environmental protection sections need to get involved in advance to effectively eradicate the catering service enterprise pollution. There are some ways to control it, such as the control of enterprise number, reasonable address selection, using clean energy and installation of pollution-source-processing facilities. To tbose that have been in business, some measures need to be carried out such as the yearly environmental check ahead of the industrial and commercial check, eliminating the unqualified enterprises gradually, and perfecting the professional management regulations as soon as possible.
