解读英国2005年《意思能力法案》

以往对于成年人监护制度的规定多见于民法总论中,并常与未成年人监护在一起,规定较为粗糙。英国2005年《意思能力法案》主要针对成年人监护中的监护人主体资格,监护人权限范围,监护人的产生方式,被监护人资格,监护程序,保护法院和公共监护人相关问题进行了规定。通过介绍《意思能力法案》,比较我国相关制度,并在此基础上引入其先进制度,并对其进行本土化,有利于改革和完善我国的成年人监护制度。

In the past, the adult guardianship systems were particularly prevalent in the general civil laws, and was often associated with the guardianship of minors together. Mental Capacity of Act in United Kingdom 2005 is the department of guardianship system for adults to further refine the provisions. This act is mainly about the guardian＇s qualification, competence, elect, and the qualification of person under guardianship, guardianship proceeding, the protection of the courts and the public guardian for adult custody. By introducing the bill and comparing related systems in our country, the main purpose in the introduction, on a comparative basis, we could introduce this advancde system, and make it localization, to reform and improve adult guardianship system in China.
