摘要
我国侵权责任法中应规定惩罚性赔偿。惩罚性赔偿有利于全面实现侵权责任法的功能、符合社会正义观的变革要求、有利于民事责任制度的协调。法律应从适用类型、程序、赔偿范围等方面对惩罚性赔偿制度进行限制。
We should stipulate punitive damages in China＇s tort law in the future, because it would help to totally realize the function of tort law, meet with the change of social justice, and make the relation of civil duties harmony. The law should restrict the punitive damages on the types, procedure and damage scope.
