摘要 近年来,我国缺陷食品损害公民权益的事件频发,政府虽然事后立即采取"下架、召回、销毁"等一系列有力措施,但此类事件已经给公民权益带来重大损害,同时也给我国对内、对外的经济贸易带来诸多不利影响。文章从实际出发,在列举了现行《食品召回管理规定》制度上和执行中存在的不足,按照已经颁布并即将于2009年6月1日起实施的《中华人民共和国食品安全法》的相关规定,结合我国的国情从食品安全实行全程监督管理、加强对食品添加剂的监管、加强风险评估制度、政府可责令企业实施召回、立法废除免检制度等方面进行了深入的研究,提出了一系列完善缺陷食品召回制度的措施。 In recent years, there are several incidents that defective foods damage the interests of citizens. Although the government takes such immediate effective measures as "removing, recalling, and destroying", the incident not only has brought great damage to the rights and interests of citizens, but also has negative effect on Chinese domestic and foreign trade. Combining with Chinese reality, according to the relevant provisions of "Chinese Food Safety Act"which has been issued and will be implemented on June 1,2009 ,this article lists some defects in the existing "Food Recalling Administration", doing deep research on some aspects including performing complete supervision to ensure food security, strengthening supervision of food additives, perfecting risk evaluating system, government making enterprises implement recalling, abolishing exemption system. Finally, some measures about perfecting system of food recalling are presented.
