自决权主体研究中的模糊问题刍议

Reflection upon the Ambiguity on the Research in the Subject of Self Determination

由于国际法在自决权主体问题上存在着一定的模糊性,导致了自决权主体研究中的泛化现象。根据国际法的宗旨和国际社会的实践,少数者(包括少数民族)、土著人、一国内部的部分人民、主权国家和个人均不得被界定为自决权主体。自决权主体只能界定为"国族"和"一个国家的全体人民"。随意扩大自决权主体的范围,不利于国际国内秩序的稳定。

There is much ambiguity in international law concerning the subject of self determination, leading to the phenomena of generalization in the subject study of self determination. Under the principle of international law and the practice within the international community, the minority （including ethnic minority）, aboriginal people, part of the people within the country, a sovereign nation, and individuals cannot be defined within the subject of self determination. The subject of self determination can only be categorized as ＂Nation state＂ and ＂all people of a nation＂. The random expansion in the scope of self determination is not conductive to the stability of domestic and international order.
