中国与国际刑事法院的文化冲突及其化解

China and ICC——in the view of cultural perspective

中国外交理念所体现的中国文化和国际刑事法院所蕴涵的西方文化存在冲突,两者不可能在短时间内融合在一起,必定有一个互相磨合的过程。所以,不加入国际刑事法院就成为中国现阶段的必然选择。文化的全球化和中西文化对于彼此的价值又决定两者必定会融合在一起,中国必将加入国际刑事法院是从文化层面分析两者关系的当然结论。

The Chinese culture that Chin＇s diplomatic policy represents and the West culture that ICC represents have many kinds of conflicts and differences. Neither China nor ICC can east away their natural culture traditions and syncretize with each other in a short time. There must be a process of mutually exclusion and syncretism of each other. So it is the inevitable choice for China government not to participate in the ICC af this stage, the development of the cultural glohalization and ether Chinese culture or West culture has its advantages and disadvantages and can satisfy the need of the each other＇s self-improvement, so China＇s acceding to ICC is a certain result of the syncretism of the Chinese and West culture. It is an unquestionable conclusion which results from the analysis on the relationship between China and ICC from the cultural perspective.
