我国反垄断执法机构设置应注意的问题

Problems Concerned with the Set-up of Antimonopoly Law Enforcement Agency in China

我国于2007年8月30日颁布了《反垄断法》,而反垄断执法机构是反垄断法能够顺利贯彻实施并充分发挥其作用的重要保障。目前,我国反垄断执法机构还存在执法效能不高、独立性不强等问题,所以在其设立的时候应充分考虑到兼顾制度的实效与成本,我国的政治、经济发展状况,以及其它一些具体国情等因素,使其具备科学性、强力性等特点。

China has already promulgated the antimonopoly law on August 30, 2007 and the antimonopoly law enforcement agency is also set up. But there exist the following questions, including lower enforcement efficiency of the law, the weak independence. China can profit from American experiences when it sets up the antimonopoly law enforcement agency. Meanwhile, it is considered the actual effect and cost, Chinese politics and economical development conditions and other concrete national conditions so that Chinese antimonopoly law enforcement agency has the scientific characteristics and the force.
