外资退出法律保障机制研究——由《外资非正常撤离中国相关利益方跨国追究与诉讼工作指引》引发的思考

Research on the legal security mechanism of divestment by foreign investors——The thought arising from guidelines of cross-border remedies and litigation work for stakeholders of China in abnormal evacuation of foreign investment

2008年12月21日商务部、外交部、公安部、司法部四部委办公厅联合发布了《外资非正常撤离中国相关利益方跨国追究与诉讼工作指引》(以下简称《指引》),对外资非正常撤离进行严厉打击。在全球性金融危机继续蔓延的情况下,出台《指引》不仅有重要现实意义,而且也对完善外资退出时的法律保障机制有重大贡献。

On December 21,2008,The Ministry of Commerce,the Ministry of Foreign Affairs,the Ministry of Public Security and the Ministry of Justice of the People＇s Republic of China,jointly released that Guidelines of Cross-border Remedies and Litigation Work for Stakeholders of China in Abnormal Evacuation of Foreign Investment （it is called ＂Guidelines＂）,which prohibited abnormal evacuation of foreign investment. Under current circumstances of expansion of the global financial crisis,the Guidelines is not only beneficial for important practical values,but also beneficial for legal security mechanism in evacuation of foreign investment.
