我国刑事程序立法理念的嬗变

The Concept Evolution of Criminal Procedural Legislation in China

立法理念是立法的先导,立法理念在很大程度上决定立法的走向。法律修改亦是如此。我国刑事诉讼法从立法到修改,再修改,立法理念经历了一个嬗变过程,这个过程反映了我国刑事程序立法的不断进步。正确确立我国刑事诉讼法再修改的理念,是我们当前的迫切任务。

Legislative concept is the primary concern of legislation and it determines to some extent the di- rection of legislation, which is also true to legal modification. The criminal procedure law in China has undergone an evolution from legislation to modification and from modification to remodification, which reflects the continuous progress in criminal procedure legislation. Therefore, it is an urgent task to properly establish the concept of remodification of criminal procedure law.
