摘要
航运反垄断豁免制度作为航运竞争法的重要组成部分,在我国立法上尚属空白,各利益集团面对航运市场的突发事件缺乏必要的立法保障。通过对欧美等国不同航运豁免制度中的管制机构和豁免程序的研究可以受到启示,我国在相关制度立法时,应由交通部从行业监管角度主管全国航运反垄断豁免的管理工作,将事前防范和事后监督结合起来,建立起备案-调查-处理的监管机制。
Although the antitrust exemption system in shipping industry (hereinafter referred to as "exemption system") has always caught legislature and judicial authorities attention of every country in the world as an important part of Shipping Competition Law, China has not established relative exemption system, which results in the fact that each interest body can not obtain legal protection when they are facing emergencies in the shipping market. The thesis aims at the systematic and theoretical studies on the exemption system of EU and USA, and suggests that the ministry of communications should include specialized management of the national antitrust exemption in prevention and supervision,and establish the system of individual exemption system of filing-inquiry-penalty in China.
