摘要
土地登记作为地籍管理的核心,在土地管理中占据着十分重要的位置。我国土地登记制度建立较晚,在实践和立法中还存在很多不足。《物权法》的实施对我国的土地登记制度产生了重要影响。在国家关于不动产登记的法律出台之前,国土资源部制定了新的《土地登记办法》,贯彻落实了《物权法》中关于不动产登记的规定,在保持土地登记制度的基础上完善创新,更加科学地定义了土地登记的相关概念,完善了土地登记的内容,规定了土地登记相关制度,优化了土地登记的程序,强化了土地登记的民事作用。但《土地登记办法》只是一部过渡性的部门规章,还存在一些不足。我国的土地登记制度依然存在登记机关不统一、管理分散、缺少土地登记损害赔偿规定等问题,需要进一步完善。
Land registration is the core of cadastral management. Land registration system in China was established relatively late, and it is still imperfect. Implementation of The Property Law has exerted an important effect on the land registration system. Before the government unveils the real estate registration law, the Ministry of Land and Resources of China adopted a revised Measures for Land Registration, which carried out the regulations about real estate registration in The Property Law, de fined the related concepts in a more scientific way, enriched its contents, optimized the procedures and strengthened the civil effects of land registrations. However, being an interim department regulation, Measures for Land Registration has some defects: lack of a unified agency for land registration, decentralized management, lack of compensation provisions and others, which need to be improved.
